Welcome to the House of Matthieu.

These Terms of Service (“Terms”) govern your access to and use of micaelmatthews.com (the “Site”), including any purchases made through the Site. By browsing the Site, creating an account, or placing an order, you agree to be bound by these Terms.

Please read them carefully before using the Site or making a purchase.

ABOUT US

MICAEL MATTHEWS is a South African streetwear brand founded in 2017 and operating under the House of Matthieu.

All products purchased through this Site are sold and fulfilled by MICAEL MATTHEWS.

ELIGIBILITY

By placing an order through the Site, you confirm that you have the legal capacity to enter into a binding agreement, or that you are doing so with the involvement and consent of a parent or legal guardian where required by law.

PRODUCTS, AVAILABILITY & PRICING

We make every reasonable effort to ensure that product descriptions, images, colours, sizing information, pricing and availability displayed on the Site are accurate.

However:

  • Colours and appearance may vary slightly depending on your device, screen settings, photography and lighting.
  • Fabric texture, fit and other characteristics may vary slightly between pieces.
  • Limited and drop-based collections are released in restricted quantities and may sell out without notice.
  • Product availability is not guaranteed until your order has been accepted and processed.
  • We reserve the right to correct pricing, product description or availability errors when identified.
  • We reserve the right to discontinue or modify products at any time without prior notice.

If we identify an error affecting an order you have placed, we will contact you and, where applicable, provide the available options, which may include cancelling the affected order and issuing a refund.

All prices are displayed in South African Rand (ZAR) and include applicable taxes unless otherwise stated.

ORDERS & PAYMENT

When you place an order through the Site, you are submitting a request to purchase the selected products at the stated price.

All orders are subject to product availability and our acceptance of the order.

We reserve the right to decline, cancel or limit an order where, for example:

  • The requested product is unavailable
  • There is an obvious pricing or product description error
  • We reasonably suspect fraudulent, unauthorised or unlawful activity
  • There is an error in the order or payment information
  • We are unable to fulfil the order for reasons beyond our reasonable control

Payment is processed securely through our approved payment partners. MICAEL MATTHEWS does not store your full payment card details.

If we cancel an order after payment has been received, any amount paid for the cancelled order will be refunded using the applicable original payment method, subject to any rights and obligations imposed by applicable law.

ORDER CONFIRMATION

After placing an order, you may receive an automated order confirmation acknowledging that your order has been received.

An order confirmation does not necessarily constitute final acceptance of the order.

Your order remains subject to product availability, payment verification and our ability to fulfil the order.

Once your order has been processed and accepted for fulfilment, you will receive the relevant dispatch and tracking information.

SHIPPING & DELIVERY

Shipping costs, processing times, delivery estimates and international shipping information are set out in our Shipping Policy, which forms part of these Terms.

Delivery times are estimates and may vary depending on the destination, courier service and circumstances outside of our reasonable control.

For international orders, customers are responsible for any applicable customs duties, import taxes, clearance fees or other charges imposed by the destination country, unless otherwise stated at checkout.

RETURNS, EXCHANGES & REFUNDS

Our return, exchange and refund procedures are set out in our Returns & Refund Policy, which forms part of these Terms.

Nothing in our Returns & Refund Policy or these Terms is intended to limit or exclude any rights you may have under applicable South African consumer protection law.

INTELLECTUAL PROPERTY

All content appearing on this Site, including but not limited to:

  • The MICAEL MATTHEWS name and logo
  • House of Matthieu branding
  • Product designs
  • Collection names
  • Photography and video
  • Graphics and artwork
  • Written content
  • Website design and layout

is owned by or licensed to MICAEL MATTHEWS and is protected by applicable intellectual property laws.

You may not reproduce, copy, modify, distribute, publish, sell, license or commercially exploit any Site content without our prior written permission.

Unauthorised use of our branding, imagery, designs or other intellectual property is prohibited.

ACCOUNT REGISTRATION

If you create an account with us, you are responsible for maintaining the confidentiality of your login details and for activity carried out through your account.

You agree to provide accurate information and to notify us promptly if you believe your account has been accessed or used without your authorisation.

We reserve the right to suspend or terminate accounts where we reasonably believe there has been misuse, fraudulent activity or a violation of these Terms.

ACCEPTABLE USE

When using the Site, you agree not to:

  • Impersonate MICAEL MATTHEWS, House of Matthieu or another person or entity

The Site may contain links to or integrations with third-party websites, platforms or services, including social media platforms, payment providers, delivery partners and other external services.

We are not responsible for the content, availability, security, policies or practices of third-party websites or services.

Your use of third-party services may be subject to their own terms and privacy policies.

FORCE MAJEURE

We will not be responsible for delays or failures in performing our obligations where such delays or failures result from circumstances beyond our reasonable control.

These circumstances may include, but are not limited to:

  • Natural disasters or severe weather
  • Government restrictions or regulations
  • Strikes or industrial action
  • Courier or logistics disruptions
  • Power or infrastructure failures
  • Supplier or manufacturing disruptions
  • Cybersecurity incidents

Where reasonably possible, we will take appropriate steps to minimise the impact of such events and keep affected customers informed.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, MICAEL MATTHEWS will not be liable for indirect, incidental, special or consequential losses arising from your use of the Site or purchase of our products.

This may include losses arising from circumstances outside our reasonable control, including delays or disruptions caused by third-party couriers, payment providers, telecommunications providers or other external service providers.

Nothing in these Terms excludes, restricts or limits any liability or consumer right that cannot lawfully be excluded or limited under applicable South African law, including rights provided under the Consumer Protection Act 68 of 2008.

PRIVACY

Your personal information is collected and processed in accordance with our Privacy Policy and applicable data protection laws, including the Protection of Personal Information Act 4 of 2013 (POPIA).

By using the Site, you acknowledge that you have read and understood our Privacy Policy.

CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our business, products, services, legal requirements or operating practices.

Updated Terms will be published on this page with a revised “Last Updated” date.

Where required by law, we will provide appropriate notice of material changes.

Your continued use of the Site after updated Terms have been published constitutes acceptance of the updated Terms to the extent permitted by applicable law.

ENTIRE AGREEMENT

These Terms, together with our Shipping Policy, Returns & Refund Policy and Privacy Policy, form the terms governing your use of the Site and your purchases from MICAEL MATTHEWS.

If there is any inconsistency between these documents, the provision required by applicable law will prevail.

GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of the Republic of South Africa.

Any disputes arising from these Terms, your use of the Site or your purchase of products from MICAEL MATTHEWS will be dealt with in accordance with applicable South African law and the appropriate South African courts or other legally available dispute-resolution mechanisms.

Nothing in this section prevents you from exercising any statutory rights or remedies available to you under applicable law.
